In order to strengthen the management of live broadcasting on ChaCha platform, create a standardised, equal and positive Internet space, and give the majority of users a better communication environment, ChaCha has formulated this live broadcasting specification, which is an inseparable part of the ChaCha user agreement and has the same legal effect as the ChaCha user agreement, so please comply with this specification and jointly maintain the live broadcasting environment of ChaCha.
This specification applies to all live broadcasting rooms on the platform, all anchors and all users (hereinafter collectively referred to as ‘live broadcasting personnel’) who join the live broadcasting of others or other live broadcasting-related functions through the use of various means such as micing and commenting, and all anchors are responsible for the content and order of their live broadcasting rooms.
ChaCha platform live broadcast personnel should strictly abide by the requirements of laws and regulations of the country/region where they are located, as well as the requirements of the platform agreement and rules (including but not limited to the ‘Terms and Conditions’, ‘Privacy Policy’, etc.) during the live broadcast process.
If the live personnel have violated this specification / or other platform rules one of the requirements, the platform has the right to depending on the severity of the violation of the circumstances to be different degrees of punishment, including but not limited to: warning, interruption of live broadcasts, close the live permissions, restrictions on the live broadcast function, blocking the account as well as the platform rules stipulated in the other penalties.
The platform firmly opposes all forms of violence and prohibits users from using the platform's services to incite, promote or glorify violence, and strictly prohibits users from using the platform's services to organise or participate in serious violent activities with the intention of causing death or injury, major property damage, damage to public facilities, and disruption of social order. The Platform prohibits users from posting content that incites, describes or demonstrates behaviour that may cause personal injury or property damage to others, or that may pose a threat or cause harm to public safety and order, or social management order.
The platform strictly prohibits users from using the platform to publish current political harmful and inaccurate information that violates laws and regulations, endangers national security, and damages the dignity and image of the government, the state and the nation. Information on current affairs refers to information on political, economic, military, diplomatic and other public affairs and social emergencies. The Platform governs current affairs information in accordance with relevant laws and regulations.
When users publish content related to domestic and international current affairs, public policies, and social events, they need to add the time and place of shooting if they produce and disseminate the content themselves, and add the source of citation if they cite the content published by other users, in order to help users judge the authenticity and timeliness of the event.
The Platform welcomes users to post useful discussions and scientific research on mental health, but prohibits the production, publication or dissemination of any content that displays, promotes, induces, encourages, organises or abets suicide and self-harm, or any negative content that reveals the identity of victims or survivors of suicide or self-harm and attacks them. Users are prohibited from live streaming of suicide or self-harm.
The platform cracks down on all kinds of violations of users' personal rights and interests, strictly governs all kinds of abusive attacks, insults and defamation, malicious speculation, violation of reputation, exposure of privacy, human searches, and other acts of violence on the Internet against individuals or groups of individuals through text, pictures, videos and other forms of content, and resolutely resists all kinds of violations of the legitimate rights and interests of users.
Firmly resist the use of the platform's services by users to produce, publish and disseminate illegal content that infringes on the rights and interests of others, such as obscenity, pornography, violence, discrimination and hate speech, or gory, thriller, over-exaggeration and other content that causes discomfort or negative physiological and psychological impact on the user's senses.
In addition to prohibiting the publication of content that violates laws and regulations or the commission of criminal offences, the platform also refuses to allow users to publish content that violates public order and morals or to commit acts that are contrary to public order and morals.
(1)The Platform attaches great importance to the protection of intellectual property rights, respects originality and encourages users to create valuable works. To this end, the Platform protects Users' intellectual property rights over their own works on the one hand, and on the other hand strictly requires that Users should not upload works that infringe the intellectual property rights of others. If a User uploads content that infringes on the intellectual property rights of others on the Platform, the Platform will deal with it in accordance with the requirements of relevant laws and regulations.
(2)The Platform prohibits the publication or dissemination of the following contents that infringe the intellectual property rights of others, or the commission of the following acts that infringe the intellectual property rights of others:
①Illegally using, without permission, content of which others have intellectual property rights, including but not limited to written works, audio-visual works and trademarks;
②Publishing, under false pretences, any content for which another person has intellectual property rights;
③Any other infringement of third-party intellectual property rights and other legitimate rights and interests;
④All original content and information posted by users on the platform belongs to the users, and users can control how such content and information is shared through privacy and application settings. However, before sharing the content, users must ensure that they have the right to publish and share such content, and that they cannot infringe on the copyrights, trademarks and other legitimate rights and interests legally enjoyed by others.
We are committed to ensuring the safety and health of minors on the platform. It is strictly prohibited for anyone to use the platform’s services to abuse, harm, endanger or maliciously utilize minors or instill wrong values in minors. It is strictly prohibited to publish content that endangers the physical and mental health of minors:
(1)It is strictly prohibited to engage in child sexual abuse and sexual exploitation behaviors, including but not limited to: inappropriate interactions targeted at a child (for example, groping or caressing); child grooming (for example, befriending a child online to facilitate, either online or offline, sexual contact and/or exchanging sexual imagery with that child); sexualization of a minor (for example, imagery that depicts, encourages or promotes the sexual abuse of children or the portrayal of children in a manner that could result in the sexual exploitation of children); sextortion (for example, threatening or blackmailing a child by using real or alleged access to a child’s intimate images); trafficking of a child (for example, advertising or solicitation of a child for commercial sexual exploitation);
(2) It is strictly prohibited for minors to live streaming as well as disseminate content that is detrimental to the physical and mental health of minors, including but not limited to: minors starting live streaming with their faces shown; minors starting live streaming without showing their faces; guiding or using minors to participate in live streaming; adults and minors appearing in live streaming together; filming minors to make them appear in the live stream, etc.;
(3) It is strictly prohibited to guide or induce minors to give live streaming rewards, recharge and consume, or receive rewards from minors;
(4) It is strictly prohibited to display pornographic content of minors, including but not limited to sexual behaviors of minors, molestation of minors, close-up displays, inappropriate displays of sensitive parts of minors or other intimate behaviors with pornographic intent;
(5) It is strictly prohibited to advocate or encourage minors to engage in illegal and criminal activities;
(6) It is strictly prohibited to display or promote the content of minors with bad orientation, including but not limited to anorexia and abandonment of school, early love, smoking, drinking, excessive violence and bloodiness, having plastic surgery, losing weight and other beauty adjustments to personal appearance;
(7) It is strictly prohibited to display or propagate deformed and unhealthy concepts of marriage and love such as underage motherhood, underage pregnancy and underage abortions;
(8) It is strictly prohibited to display or propagate contents that endanger the life and health of minors, including but not limited to beating, abusing, mistreating and physically punishing minors, as well as displaying or disseminating contents related to school bullying;
(9) It is strictly prohibited to disclose the personal privacy of minors or content that is detrimental to the personal dignity of minors;
(10) It is strictly prohibited to induce minors to participate in undesirable organizations, activities that affect their normal study/rest, etc;
(11) Other contents that may endanger the personal safety and health of minors.
(1)The Platform prohibits Users from engaging in cheating behaviours or posting spammy content that is intended to deceive or mislead Users in order to increase the number of views;
(2)The Platform prohibits Users from posting content about services and transactions that violate laws and regulations;
(3)The Platform prohibits Users from directing other Users to third-party platforms that may endanger the personal rights and interests of Users and the safety of their property through deception or inducement;
(4)The Platform prohibits Users from using the Platform's services to gain the trust of other Users through deceptive means or to direct other Users to other off-site platforms for the purpose of fraud; Users are prohibited from obtaining interactions and traffic through various types of deceptive behaviours or means. The platform will actively cooperate with the actions of law enforcement and judicial authorities to combat fraud on the platform.
(1)The Platform resists and combats all kinds of behaviours that undermine the order of the Platform and endanger the network security of the Platform:
①The platform prohibits any content or behaviour that maliciously harms the rights and interests of the platform and disrupts the normal operating order of the platform:
②Unauthorised use of ChaCha trademarks, logos or other intellectual property rights without the authorisation of the platform;
③Counterfeiting or imitating ChaCha official accounts or ChaCha staff without platform authentication;
④Using the name of ChaCha to promote accounts or other marketing activities without authorisation from the platform;
⑤Organising, inciting or guiding an unspecified majority of users to report malicious complaints in some way on or off the platform;
⑥Other contents or behaviours that maliciously damage the rights and interests of the platform and disturb the normal operation order of the platform.
(2)The platform prohibits any content or behaviour that undermines the security and reliability of the platform services:
①Invading ChaCha's website, applications or related networks, or bypassing the platform's functional design or protective measures, including but not limited to restricting users' access rights;
②Distributing information containing viruses, Trojan horses, computer worms, logic bombs or other malicious or harmful content;
③Modify, adapt, translate, reverse engineer, reverse assemble, reverse compile, or create any derivative product based on the Platform (including any program, web page, form, or document) or attempt to reproduce any source code, algorithm, methodology, or technology embedded in the Platform;
④Use automated scripts to collect information and crawl data from the Platform in bulk;
⑤Other contents or behaviours that infringe and threaten the network security of the Platform.
1.If live streaming personnel commits the above violations, the platform will, based on the violation situation and the number of violations, impose punishments such as warnings, interrupting live streaming, restricting live streaming functions, closing live streaming permissions, and banning accounts on the live streaming personnel's accounts and/or corresponding live streaming rooms. If there are any objections to the platform's treatment based on these regulations, the anchor can file a complaint with the platform after the violation is punished.
2.Users can use the ‘report’ function to report the violation of the live staff, the platform will immediately deal with the violation after verification, if the user's report is found to be malicious behaviour, the platform will also be dealt with accordingly.
Please fully understand the original intention of the platform to develop this specification, do not try to use this specification can not exhaust all the limitations of specific violations of sobriety, contrary to the basic principles of this specification, to circumvent the platform's supervision and management, and punitive measures.
The end of the live broadcast does not mean the end of the platform management, the platform has the right to retrospective punishment for the historical violations of the live broadcast personnel found by the platform back or the user report.
The platform has the right to punish the live broadcast personnel's violations in accordance with this specification. If the violation violates laws and regulations at the same time, the platform will also save the relevant information and data and report to the supervisory authorities on its own initiative.
When the platform deems necessary, the platform has the right to unilaterally modify the content of this specification, the relevant content changes will be updated through the page of this specification in advance of a reasonable period of time for publicity, live personnel can view at any time; such as live personnel continue to use the platform after the update of this specification to the live broadcasting and other services, that is, considered to be a live personnel have accepted the modified specification; such as live personnel do not accept the modified relevant content, should be immediately stop using the live broadcasting and other services provided by the platform.
